Terms of Use.

These Terms of Use ("Terms") govern your access to and use of the Endless Sports Complex website at endlesssportscomplex.com ("the Site") and the related programs, services, memberships, lessons, club teams, camps, and facility use offered by Endless Sports Complex ("Endless," "we," "us," "our"). By using the Site or our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

1. Eligibility

You must be at least 18 years old, or have permission from a parent or legal guardian, to submit information or book services through this Site. Parents and legal guardians are responsible for all activity associated with their minor athletes.

2. Use of the Site

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You will not:

• Use the Site to violate any applicable law or regulation.
• Attempt to disrupt, damage, or gain unauthorized access to the Site, our servers, or related networks.
• Scrape, harvest, or otherwise extract data from the Site at scale without our written permission, except by good-faith search engine or AI indexing crawlers operating in compliance with our robots.txt.
• Misrepresent your identity in any communication with us.

3. Memberships, lessons, and bookings

Memberships and private lessons are booked through our partner platform RunSwift. Bookings made through RunSwift are subject to RunSwift's own terms in addition to ours. Endless Club tryouts and email list signups are collected through Google Forms and subject to Google's terms.

Pricing, schedules, and program availability are subject to change. Programs may be modified, rescheduled, or canceled at our discretion.

4. Cancellation and refunds

Membership cancellation, refund, and pause terms are described on our Training page and apply in full. Briefly:

• Memberships are month-to-month unless otherwise specified.
• Cancellation requires at least 14 days' written notice prior to the next billing date.
• Membership fees are non-refundable, including for partial months, unused sessions, or missed visits.
• Memberships may not be paused, transferred, or shared without written approval.
• We may suspend or terminate memberships for policy violations, misuse, non-payment, or unsafe conduct.

Camp, clinic, lesson, and rental refund and rescheduling terms are provided at the time of booking and may differ from membership terms.

5. Facility rules and conduct

While at the facility, all guests must follow posted rules, instructions from Endless staff, and standard safety protocols. We reserve the right to refuse entry or remove anyone whose behavior is unsafe, disruptive, or otherwise inconsistent with the environment we are committed to maintaining.

6. Assumption of risk

Participation in baseball, softball, training, lessons, camps, club programs, simulator use, and any other activities at Endless Sports Complex involves inherent risks of injury, including serious injury. By using our services, you acknowledge these risks. A separate written liability waiver and release is required for membership, lesson participation, club enrollment, camp registration, and facility entry. These signed agreements control over anything in these Terms if they conflict.

7. Participation of minors

Athletes under 18 may participate only with the consent of a parent or legal guardian. The parent or guardian is responsible for completing all required waivers and forms, providing accurate medical information where relevant, and ensuring the minor follows facility rules.

8. Intellectual property

The Site and its content — including text, photos, graphics, video, logos, the Endless name, the Endless Sports Complex name, the lime accent color usage in our brand system, and all other brand assets — are the property of Endless Sports Complex or its licensors and are protected by intellectual property laws.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any Site content for commercial purposes without our prior written permission. Limited personal, non-commercial use (such as sharing a page on social media) is permitted.

Third-party trademarks referenced on the Site — including TrackMan, Rapsodo, Blast Motion, Spinball iPitch, HitTrax, and FungoMan — are the property of their respective owners.

9. Third-party links and services

The Site links to and embeds third-party services, including RunSwift, Google Forms, Google Maps, Google Fonts, Netlify, and Instagram. We are not responsible for the content, terms, privacy practices, or availability of those third-party services. Your use of them is governed by their respective terms.

10. Disclaimers

The Site and our services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that the Site will be free of errors, viruses, or other harmful components, or that defects will be corrected.

Information on the Site about programs, technology, schedules, pricing, coaches, and facility features is provided for general information and is subject to change. Always confirm current details before booking or visiting.

11. Limitation of liability

To the fullest extent permitted by law, Endless Sports Complex, its owners, employees, contractors, coaches, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Site or our services — even if we have been advised of the possibility of such damages.

Our total cumulative liability for any claim arising out of or relating to the Site or these Terms will not exceed the greater of (a) the amount you have paid to Endless in the 12 months preceding the claim, or (b) one hundred U.S. dollars ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Endless Sports Complex and its owners, employees, contractors, coaches, and affiliates from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Site, or your violation of applicable law.

13. Governing law and venue

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Weld County, Colorado, and you consent to the personal jurisdiction of those courts.

14. Changes to these Terms

We may revise these Terms from time to time. The "Last updated" date above reflects the most recent change. Material changes will be highlighted on this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
